Rights
and obligations of the grandparents
Generally, the grandparents benefit from the right
of having their grandchildren visiting them and
lodging them. This right can be refused to them
only for serious reasons. They have, in addition
a nourishment obligation towards their grandchildren
in need.
Which are the rights of the grandparents ?
The grandparents have a right of access and
lodging of their grandchildren, but also the right
to exchange a correspondence with them and to take
part in their education insofar as they do not replace
the parents.
These rights remain valid :
- In the event of divorce of the parents,
- in case of a natural child,
- when the small-child is adopted.
It can also happen that the grandparents see
themselves entrusted with the guard of their grandchildren :
- In the event of divorce of the parents if the
child cannot remain in the residence of one or
both,
- if the parents are deprived of their parental
authority; in this case, the grandparents must
respect the right of access of the parents. These
rights can be withdrawn by the judge only for
serious reasons.
